Refund Policy

1. To receive a refund, simply cancel your order.
2. Be sure to abide by the terms in the cancelation policy in order to receive a full refund.
3. If you miss the cancelation deadline, you will only receive a half refund.
4. If you cancel your order after the sketch has been finalized, you will only receive a half refund.
5. After your order is finished there will be NO REFUNDS!

Cancelation Policy

1. To cancel your order, simply contact me on Instagram or TikTok depending on where you placed the order.
2. You must cancel within 3 days of placing the order.

Payment Policy

1. I only accept PayPal at the moment. [more options coming soon]
2. You must pay in full upfront.
3. If your order is over $100, you can request to pay half of the total price upfront and the rest when the commission is finished.

Terms

COMMISSION PURCHASE CLICKWRAP AGREEMENTCAREFULLY READ THE FOLLOWING AGREEMENT. THIS COMMISSION PURCHASE CLICKWRAP
AGREEMENT [THE “AGREEMENT”] CONTAINS IMPORTANT INFORMATION ABOUT RIGHTS
AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS AND HAS BINDING LEGAL
EFFECT. BY ORDERING COMMISSIONED MATERIAL, YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT AND ITS TERMS.
This Commission Clickwrap Agreement [the “Agreement”] is made between Cozy Comet [the “Artist”] and you [hereinafter “you” or the “Buyer”], collectively referred to as the “parties” WHEREAS the Buyer wishes to commission the Artist to create artwork and sketches [the “Commissioned Materials”] according to the terms set forth in this Agreement;
NOW THEREFORE in consideration of the above recitals and the mutual promises and benefits
contained here, the parties enter into the following Agreement:
1. PAYMENT, CANCELATION, and REFUNDS
Payment in full is required at the time of your purchase. Your purchase will not be deemed
complete, and Artist shall have no obligation to begin work on the Commissioned Materials until payment of the complete total has been received.
Once the Commissioned Materials have been completed and delivered to you, refunds will not be provided. However, a full refund of the purchase price will be permitted if Artist receives a written notice of cancellation. Such notice must be delivered to [email protected] or whichever platform the order was placed within the “Initial Work Period”, which is defined as the earlier of [a] 3 days after your purchase is made, or [b] the date Artist completes and delivers an initial sketch to you for your review.
After the Initial Work Period, partial refunds may be granted solely at the discretion of the Artist.
2. CREATION, COMPLETION, AND DELIVERY OF COMMISSIONED MATERIALS
Artist reserves the right to refuse to create any Commissioned Materials for any reason whatsoever.
If Artist refuses to fulfill your order, a full refund will be issued within a commercially reasonable time.
By purchasing Commissioned Materials, you hereby agree that Artist retains control over the creative process and timeline associated with creating the Commissioned Materials. You further understand that, depending on the nature, complexity, and specification of the Commissioned Materials, Artist may require additional time to complete your Materials, and you hereby agree to any extensions deemed necessary in Artist’s sole discretion.
3. RESERVATION OF RIGHTS
By purchasing the Commissioned Materials, you agree not to claim ownership or authorship of the Commissioned Materials or underlying subject matter.
The Artist hereby retains full ownership and all rights, including but not limited to copyrights, intellectual property rights, and any other proprietary rights, to all Commissioned Materials, including artwork, sketches, line art, flat colorings, or renderings, and the underlying subject matter, created pursuant to this Agreement.
The Buyer acknowledges and agrees that ownership of the physical artwork and sketches does not confer ownership of the underlying rights to reproduce, distribute, display, or create derivative works based on the Commissioned Materials or underlying subject matter. The Buyer further agrees not to reproduce, distribute, display, or create derivative works of the Commissioned Materials or underlying subject matter without the prior written consent of the Artist. Buyer further agrees not to change, alter, remove, or otherwise edit Artist’s signature or watermark on any Commissioned Materials.
This retention of rights clause shall survive the termination or expiration of this Agreement.
4. TENNESSEE CHOICE OF LAW and ARBITRATION
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflicts of law principles.
Any dispute arising out of or relating to this Agreement, including the existence, validity, interpretation, performance, breach, or termination thereof, shall be finally resolved by arbitration in accordance with the rules of the American Arbitration Association then in effect. The place of arbitration shall be Johnson City, Tennessee. The arbitration shall be conducted by a single arbitrator, appointed in accordance with the said rules.
The decision of the arbitrator shall be final and binding upon the parties and may be entered in any court having jurisdiction thereof.
5. MODIFICATION and ENTIRE AGREEMENT
Any modification to this Agreement shall be valid only if in writing and signed by both parties. This Agreement constitutes the entire understanding and agreement between the parties concerning the subject matter herein and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
6. SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable for any reason by a court with jurisdiction, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as limited in that way.
7. HEADINGS
The headings used in this Agreement are for convenience only and shall not be used to construe or interpret the provisions of this Agreement.
8. ACCEPTANCE
BY ORDERING COMMISSIONED MATERIAL, BUYER EXPRESSLY ACKNOWLEDGES AND AGREES THAT THEY HAVE READ THIS AGREEMENT AND FURTHER AGREES TO AND CONSENTS TO BE BOUND BY ALL OF THE TERMS OF THIS AGREEMENT.
